REPORTING INCIDENT

Purpose

To outline the handling of non-compliance and/or reportable incidents related to living vertebrate animals at ÂÌñ»»ÆÞ. Monitoring and reporting of non-compliance are key components of the protection of laboratory animals in research and are critical to the function of the IACUC at ÂÌñ»»ÆÞ.

CSU East Bay's Committment to Individual's Who Report

CSU East Bay is committed to the humane use of live vertebrate animals in research and instruction as well as protecting the rights of individuals who report animal welfare concerns. Any individual with concerns that pertain to the care and/or use of research animals at ÂÌñ»»ÆÞ is encouraged to report the situation. ÂÌñ»»ÆÞ complies with the concerns reporting requirements of the Animal Welfare Act and Regulations and the Guide for the Care and Use of Animals.

The University's Institutional Animal Care and Use Committee (IACUC) is required by law to investigate reports of suspected animal neglect, abuse, or mistreatment. If you observe or suspect neglect, abuse, or mistreatment, or non-compliance with federal, state, or local regulations, or non-compliance with an approved protocol, please report the incident. The IACUC will investigate and evaluate concerns raised by anyone regarding the care and use of animals at ÂÌñ»»ÆÞ. 

The Federal Animal Welfare Act prohibits discrimination or reprisal against any person reporting a violation of animal welfare regulations or standards. The Animal Welfare Act Regulations provide that "No facility employee, Committee member, or laboratory personnel shall be discriminated against or by subject to any reprisal for reporting violations of any regulations or standards under the act." (9 CFR § 2.32(c)(4)).

CSU East Bay also prohibits discrimination or retaliation against individuals who, in good faith, report concerns. Individuals who file a report have the right to do so anonymously, or the reporting individual may request confidentiality. A delegate of the IACUC will investigate the report and bring the concerns and findings in a timely manner to the committee.
